1. Overview

Welcome to Fungura ("Fungura", "we", "our", or "us"). Fungura is India's Mushroom Nutrition Company, committed to bringing Nature's Protein for Every Home through premium mushroom-based nutrition while supporting sustainable agriculture and empowering Indian farmers.

These Terms & Conditions ("Terms") govern your access to and use of the Fungura website, mobile applications, WhatsApp Business, AI-powered chatbot, online store, social media channels, digital content, and all related products and services (collectively the "Platform"). By accessing, browsing, creating an account, placing an order, subscribing, interacting with our AI assistant, or otherwise using the Platform, you agree to be legally bound by these Terms.

2. Our Business

Fungura develops, manufactures, markets, and distributes premium mushroom-based food products designed to make natural nutrition part of everyday life — including Mushroom Protein Powder, Dried Oyster Mushrooms, future nutrition products, online sales, subscription services, recipes and educational content, customer support, distributor and retail partnerships, farmer partnership programs, and wellness initiatives.

3. Definitions

Account means your registered customer account. Customer means any individual or organisation purchasing or intending to purchase products. Platform means the Fungura website, applications, WhatsApp Business, AI chatbot, and all digital services. Products means all physical products sold. Services means customer support, subscriptions, recipes, educational content, AI assistance, newsletters, promotions, and other digital services. User means every visitor, customer, distributor, retailer, farmer, business partner, or individual accessing the Platform.

4. Eligibility

By using this Platform you represent that you are at least 18 years of age or the age of majority under applicable law, have legal capacity to enter into a binding agreement, that all information provided is accurate and complete, and that you will use the Platform only for lawful purposes.

5. User Accounts

You agree to provide accurate information, keep your credentials secure, notify us of any unauthorized use, and keep your contact information updated. You are responsible for all activities conducted through your account. Fungura reserves the right to suspend or terminate accounts that violate these Terms.

6. Products

We make every effort to ensure product descriptions, photographs, nutritional information, and pricing are accurate. Product images are for illustration only, natural food products may vary slightly in colour, texture, size or appearance, packaging design may change, and availability is subject to stock.

7. Nutritional Information & Disclaimer

Fungura products are food products. They are not medicines and are not intended to diagnose, treat, cure, or prevent any disease. Nutritional information is intended solely for educational and informational purposes. Customers with allergies, medical conditions, dietary restrictions, or pregnancy-related concerns should consult a qualified healthcare professional before consuming any new food product.

8. Orders

All orders are subject to acceptance and availability. Order confirmation does not constitute final acceptance. Fungura reserves the right to accept or reject any order, limit purchase quantities, cancel suspected fraudulent or duplicate orders, and refuse transactions violating applicable laws.

9. Pricing

Prices are displayed in Indian Rupees (INR). Applicable taxes will be indicated during checkout. Promotional pricing is valid only during the stated promotional period. Fungura reserves the right to revise prices without prior notice.

10. Payments

Payments are processed through authorized third-party payment service providers. Fungura does not store your complete credit card, debit card, CVV, UPI PIN, or banking credentials.

12. Returns & Refunds

Returns, cancellations, replacements, and refunds shall be governed by our Return, Refund & Cancellation Policy. Due to the nature of food products, opened or used products may not be eligible for return except where required by law or where the product is damaged, defective, or incorrectly delivered.

13. Subscriptions

Where offered, subscription plans renew per the selected plan unless cancelled. Customers may pause or cancel per the subscription terms shown during purchase. Fungura reserves the right to revise subscription pricing with prior notice.

14. AI Assistant ("Fungi")

Our AI assistant provides product guidance, recipes, general nutritional information, customer support, and website navigation. It does not provide medical advice, diagnosis, or treatment recommendations. Information generated should not replace professional medical or nutritional consultation.

15. Intellectual Property

All content on the Platform — logo, brand name, graphics, product images, videos, recipes, website design, software, AI assistant content, and educational materials — is the exclusive intellectual property of Fungura or its licensors. No content may be copied, reproduced, distributed, modified, or commercially exploited without prior written permission.

16. User Conduct

Users agree not to violate applicable laws, attempt unauthorized access, upload malicious software, interfere with security, misuse promotional offers, submit false information, post unlawful, offensive, or defamatory content, or copy/scrape website content without authorization.

17. Third-Party Services

The Platform may integrate with third-party providers including payment gateways, logistics partners, analytics providers, marketing platforms, and social media platforms. Fungura is not responsible for the independent practices, policies, or services of such third parties.

18. Limitation of Liability

To the maximum extent permitted by applicable law, Fungura shall not be liable for indirect, incidental, consequential, special, or punitive damages arising from use of the Platform, delivery delays, temporary service interruptions, third-party service failures, user misuse of products, or reliance on informational content. Nothing in these Terms limits liability where such limitation is prohibited by law.

19. Indemnity

You agree to indemnify and hold harmless Fungura, its directors, employees, affiliates, partners, and service providers against claims, damages, losses, liabilities, and expenses arising from your misuse of the Platform or breach of these Terms.

20. Force Majeure

Fungura shall not be liable for delays or failure to perform obligations caused by events beyond its reasonable control, including natural disasters, government actions, pandemics, strikes, cyber incidents, or supply chain disruptions.

21. Termination

Fungura reserves the right to suspend or terminate access to the Platform where these Terms are violated, fraud is suspected, security is compromised, required by law, or necessary to protect customers or the Platform.

22. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts located in the registered city/state of Fungura, unless otherwise required by applicable law or agreed through arbitration.

23. Changes to these Terms

We may update these Terms periodically to reflect changes in our business, products, services, or applicable laws. Continued use of the Platform after updates constitutes acceptance of the revised Terms.
